Civil Law and National Unity

Le Canada est un pays multiculturel doté de deux langues officielles, le français et l’anglais. Le Canada tire sa force de son  bilinguisme et de son multiculturalisme. Au niveau du droit, ce multiculturalisme se traduit par un dualisme juridique : la tradition juridique au Canada repose sur des principes de Common Law, mais aussi de droit civil au Québec. Les différences de la Common Law et du droit civil nourrissent le système juridique canadien. Au Québec, les étudiants québécois manient tant le droit civil que la Common Law. Par conséquent, ils sont très prisés sur la scène internationale, notamment au sein des institutions internationales pour qui ce dualisme est une grande force. À l’heure de la mondialisation, et alors que de nouvelles « zones de marché » apparaissent, le Canada est en train de se positionner comme une plaque tournante du commerce international avec l’entrée en vigueur prochaine de l’AECG. Pour prospérer, le Canada doit continuer de diversifier ses partenaires commerciaux et de s’imposer comme un acteur économique majeur sur la scène internationale. En parallèle, des grandes tendances se dessinent, comme la montée en puissance de pays émergents. Parmi ces marchés d’avenir se trouvent l’Afrique ou encore la Chine, où la tradition juridique civiliste est très présente. Selon le Fonds monétaire international, certaines des économies les plus dynamiques du monde sont en Afrique sub-saharienne. En 2014, la Chine est devenue la 1ère puissance économique mondiale selon son PIB mesuré en termes de parité de pouvoir d’achat, passant ainsi devant les États-Unis.
 
Or, de nombreux pays ont compris l’intérêt que représentent ces nouveaux marchés et ont la volonté de nouer avec eux des liens économiques étroits. Par exemple, les États-Unis cherchent à établir des relations privilégiées avec les pays africains et avec la Chine. Ainsi, en août dernier, 50 chefs d’État africains ont participé au 1er Sommet États-Unis – Afrique à Washington. Le gouvernement américain a annoncé de nouveaux engagements américains en Afrique pour un total de $33 milliards. Toujours en 2014, la Chine et les États-Unis ont annoncé une série d’initiatives bilatérales visant à mettre fin aux divergences entre les deux pays et à améliorer leur coopération. En outre, la France est un interlocuteur historique privilégié des États de l’Afrique francophone. Par conséquent, au sein de ces nouveaux marchés, le fait que le système juridique canadien soit issu autant du droit civil que de la Common Law représente un atout majeur par rapport aux pays qui ne connaissent que la Common Law tels que les États-Unis. De plus, cela lui donne les moyens pour rivaliser avec les pays de tradition civiliste, tels que la France. Il est donc clair que le Canada doit entretenir et cultiver cette richesse juridique. Toutefois, le Québec est la seule province canadienne où le droit civil est appliqué. Dès lors, le risque existe que la Common Law finisse par prendre le pas sur le droit civil. Placer l’enseignement du droit civil au centre des politiques pédagogiques dans les écoles de droit partout au Canada est donc d’une grande pertinence pour entretenir la dualité du système juridique et assurer au Canada un statut à part et privilégié sur la scène économique internationale.
